HRSA's HIV/AIDS Bureau (HAB) has posted a dear colleague letter (also presented below) announcing the retirement of HAB Policy 11-06, AIDS Drug Assistance Program (ADAP): Use of Funds, Eligibility, and Formulary Parity, Administration, Quality Assurance and Cost-Savings. This letter also lists existing HAB Policy Clarification Notices that instead address issues related to the implementation and funding of ADAPs.

Program Letter: Retirement of 11-06 AIDS Drug Assistance Program: Use of Funds, Eligibility and Formulary Parity, Administration, Quality Assurance and Cost-Savings

Dear Ryan White HIV/AIDS Program Colleagues:

This letter formally announces the retirement of the Health Resources and Services Administration (HRSA) HIV/AIDS Bureau (HAB) policy 11-06 AIDS Drug Assistance Program: Use of Funds, Eligibility and Formulary Parity, Administration, Quality Assurance and Cost-Savings. HAB determined that policy 11-06 is no longer necessary due to the issuance of subsequent Policy Clarification Notices (PCN) and based on the statutory language of the Ryan White HIV/AIDS Program (RWHAP).

The RWHAP statutory language most pertinent to AIDS Drug Assistance Programs (ADAP) can be found at section 2616 of title XXVI of the Public Health Service (PHS) Act. Section 2618(b)(3) of the PHS Act addresses administrative and quality assurance requirements, and section 2622( d) of the PHS Act addresses the treatment of pharmaceutical rebates. The requirement that program funds used for the acquisition of drugs be expended in the most economical manner feasible is codified at 42 C.F.R. § 50.503.

In addition, the following current PCNs address additional clarifications for implementation and funding of ADAPs:
